Your Filipino waiter and any other foreign mariners (assuming they don't have any of the various kinds of US visas set forth in 49 CFR section 1572.105) aren't even eligible for a TWIC. This led to TSA labeling a number of foreign oceanography graduate students (who applied for TWICs as they needed to do research cruises on their universities' research vessels) as "security risks." Contrast this to foreign students at maritime academies, who can get TWICs.
